Terms of Agreement and Service:

These said Terms of Agreement and Service shall take precedence over any written agreement.

FORCE MAJEURE

No Party shall be liable for any failure to perform its obligations where such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), terrorist activities, or interruption or failure of electricity (or telephone service), and no other Party will have a right to terminate this Agreement in such circumstances.

DURATION OF AGREEMENT

Duration of the Agreement shall be set forth in signed agreement(s).
Termination at times other than renewal will be as follows:
- At any time the Client wants to terminate agreement, they may do so at no additional fee, however, no refund for prepaid services will be given.
- At any time BMJ Solutions wants to terminate this agreement, BMJ Solutions will provide the Client with 30 days notice, and provide a pro-rated refund within 30 days for any fees pre-paid by Client for services non-rendered, and/or hand over all services for remainder of agreement.
Termination during Renewal Period

At any time the Client wants to terminate this agreement, they may do so at no additional fee, however, no refund for services will be given.

At any time BMJ Solutions wants to terminate this agreement, BMJ Solutions will provide the Client with 30 days notice, and provide a refund for Pre-Paid services non-rendered during the initial term, and/or hand over all services for remainder of agreement.
Month to Month, or Quartly Renewals are Pre-Paid Services, and Refunds will not be given. All Services remaining will be handed over for remainder of pre-paid agreement.

CHANGE OF AGREEMENT

Any Change of the Agreement shall void any agreement and require an amended agreement
All Change to Agreements must be agreed upon by both the Client and Service Provider

CHOICE OF LAW

This agreement shall be interpreted under the laws of the State of Florida. Any litigation under this agreement shall be resolved in the courts of Gilchrist County, State of Florida.

Said Term of Agreement and Service shall change at discretion of BMJ Solutions.

BMJ Solutions Web Site Agreement

The www.bmjsolutions.net Web Site (the "Site") is an online information service provided by BMJ Solutions ("www.bmjsolutions.net "), subject to your compliance with the terms and conditions set forth below. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE ACCESSING OR USING THE SITE. BY ACCESSING OR USING THE SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW. 1. Copyright, Licenses and Idea Submissions.

The entire contents of the Site are protected by international copyright and trademark laws. The owner of the copyrights and trademarks are www.bmjsolutions.net, its affiliates or other third party licensors. YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON THE SITE, INCLUDING TEXT, GRAPHICS, CODE AND/OR SOFTWARE. 5.Term; Termination.

This Agreement may be terminated by either party without notice at any time for any reason. The provisions of paragraphs 1 (Copyright, Licenses and Idea Submissions), 2 (Use of the Service), 3 (Indemnification), 4 (Third Party Rights) and 6 (Miscellaneous) shall survive any termination of this Agreement.

6.Miscellaneous.

This Agreement shall all be governed and construed in accordance with the laws of The United States of America, State of Florida, applicable to agreements made and to be performed in The United States of America. You agree that any legal action or proceeding between www.bmjsolutions.net and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a Florida State court of competent jurisdiction sitting in The United States of America, State of Florida, County of Gilchrist . Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. www.bmjsolutions.net's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. www.bmjsolutions.net may assign its rights and duties under this Agreement to any party at any time without notice to you.
